A Texas Federal Court overturned the Department of Labor’s rule which would have increase the minimum annual salary necessary to qualify for the Fair Labor Standards Act’s “white collar” exemption. The rule increased the qualifying salary from $23,660 to $47,476.
The Court held that the proposed increase was improper because the FLSA specifically defines the duties which qualify for an exemption, and the size of the increase improperly made the salary amount the sole defining factor in identifying exemptions.
